Terms of Service

1. Acceptance of these Terms

These Terms of Service (“Terms”) govern your access to and use of the Welcome Property Management website at welcomepropertymanagement.com (the “Site”). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.

These Terms apply to your use of this marketing website only. They do not replace or modify any separate written agreement you may have with us — such as a property management agreement, brokerage agreement, lease, or other signed contract — which govern those relationships on their own terms.

2. Use of the Site

You may use the Site for lawful purposes related to learning about and contacting Welcome Property Management. You agree not to: use the Site in violation of any applicable law; attempt to gain unauthorized access to any part of the Site or its systems; interfere with or disrupt the Site’s operation; use any robot, scraper, or other automated means to access or collect data from the Site; or use the Site to transmit any harmful or unlawful content. We may suspend or restrict access to the Site at any time, without notice, for any reason.

3. Intellectual property

The Site and its contents — including text, graphics, logos, icons, images, and design — are owned by or licensed to Welcome Property Management and are protected by copyright, trademark, and other laws. “Welcome Property Management” and our logo are our trademarks. We grant you a limited, non-exclusive, non-transferable license to view and use the Site for the purposes described above. You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written permission.

4. Submissions and forms

When you submit information through a form on the Site — such as our Request a Proposal or contact form — you represent that the information is accurate and that you have the right to provide it. You grant us permission to use the information you submit to respond to your inquiry and provide our services. Please do not submit confidential or sensitive information through the Site’s forms unless we request it.

5. Property information and listings

Any property, service, pricing, or market information on the Site is provided for general informational purposes only. It may not always be current, complete, or accurate, and it is subject to change without notice. Nothing on the Site is an offer, solicitation, or guarantee, and you should confirm any information with us directly before relying on it.

6. Equal housing opportunity

Welcome Property Management is committed to the principles of equal housing opportunity. We do not discriminate on the basis of race, color, religion, sex, disability, familial status, national origin, or any other characteristic protected by federal, state, or local law.

7. Resident and owner portals

The Site may link to third-party resident and owner portals (for example, our Buildium-hosted Resident Center and Owner portal). Your use of those portals is governed by the applicable third party’s own terms and privacy practices, not these Terms.

8. Third-party links

The Site may contain links to third-party websites or services that we do not control. We provide these links for convenience only and are not responsible for the content, products, or practices of any third-party site. Following a link is at your own risk.

9. Text messaging (SMS) terms

These terms apply if you provide your mobile phone number to Welcome Property Management or otherwise opt in to receive text messages from us.

Program description. When you provide your mobile phone number — for example, on one of our forms, by checking a text-message consent box, or by replying to an opt-in prompt — you consent to receive SMS text messages from Welcome Property Management. Depending on your relationship with us, these messages may include service and maintenance-request updates, account and community notifications, appointment or lease-related reminders, urgent or time-sensitive notices, responses to your inquiries, and, where you have separately agreed to receive them, occasional promotional messages.

Message frequency. Message frequency varies based on your interactions with us.

Message and data rates. Message and data rates may apply, depending on your mobile carrier and plan.

Opting out. You can opt out at any time by replying STOP to any text message you receive from us. After you opt out, we will send a one-time confirmation message and will not send you further texts unless you opt in again.

Getting help. Reply HELP to any message for assistance, or contact us at larry@welcomepropertymanagement.com or (424) 371-2761.

Carriers. Mobile carriers are not liable for delayed or undelivered messages.

Consent. Your consent to receive text messages is not a condition of purchasing any property, service, or product from us.

Privacy. Information collected in connection with our text-messaging program is handled in accordance with our Privacy Policy. As stated there, we will not sell, rent, or share your information — including your mobile phone number — with third parties or affiliates for their own marketing purposes.

Compliance. Our text-messaging program is intended to comply with applicable requirements, including CTIA guidelines and the Telephone Consumer Protection Act (TCPA).

10. Disclaimers

The Site is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

11. Limitation of liability

To the fullest extent permitted by law, Welcome Property Management and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, use, or goodwill, arising out of your use of or inability to use the Site. To the extent any liability cannot be excluded, our total liability for any claim arising out of or relating to the Site is limited to one hundred dollars ($100).

12. Indemnification

You agree to indemnify and hold harmless Welcome Property Management and its owners, employees, and affiliates from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site or your violation of these Terms.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the effective date above. Your continued use of the Site after changes take effect means you accept the updated Terms.

14. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.

15. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, are the entire agreement between you and Welcome Property Management regarding your use of the Site. Our failure to enforce any provision is not a waiver of it.
